Otakuio, operated by Hai Ha LLC, respects the intellectual property rights of others and expects its users and customers to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.

This policy outlines the process for submitting a copyright infringement notification and the actions we may take in response.

1. Notification of Copyright Infringement

If you believe that content on otakuio.com infringes your copyright, you may submit a written notification (a “DMCA Notice”) to our Designated Copyright Agent. Your notice must include the following information as required by the DMCA (17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed.
  3. A description of where the allegedly infringing material is located on our website (please provide the specific URL if possible).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright interest.

2. Our Response to Valid Notices

Upon receipt of a valid DMCA Notice, we will promptly investigate the claim. If we determine that the material infringes copyright, we may:

  • Remove or disable access to the allegedly infringing material
  • Notify the user or seller who posted the material
  • Terminate the accounts of repeat infringers in appropriate circumstances

3. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent. Your Counter-Notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Colorado if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA Notice.

Upon receipt of a valid Counter-Notification, we may restore the material unless the original complainant files a court action seeking to restrain the alleged infringement within 10–14 business days.

4. Repeat Infringers

Hai Ha LLC reserves the right to terminate access to the Site for users who are determined to be repeat infringers of intellectual property rights.

5. Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages.
